How to handle the traffic flow in new session when both the links are SLA violated with gradual migration ON?

Solution

Gradual migration impacts only the existing flows. New flows always gets load balanced between all available paths at the highest priority.

Flows will be load balanced between the two paths that are SLA violated, as this is the highest priority.
